Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of ESP-GenUI (the "Service"), operated by G9Six, LLC ("we", "us", or "our"). The Service includes the ESP-GenUI website and the ESP-GenUI mobile app. By creating an account, signing in through a third-party provider, installing the mobile app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Section 11 covers the mobile app, which requires no account and is provided free of charge; the plan, credit, licence, and refund terms in Sections 6 through 9 apply to the website only.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

2. Accounts and Authentication

We use third-party authentication providers to help securely manage user sign-in and account authentication. You may create an account with an email and password, or sign in using a supported third-party provider (such as Google). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Email/password accounts must verify their email address before full access is granted.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems and networks.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or attempt to extract the source code of the proprietary code generator or other non-public components.
  • Upload or transmit malicious code, or use the Service to do so.

4. Your Content

The Service lets you create, save, and generate diagrams and source code ("Your Content"). You retain ownership of Your Content. You grant us a limited license to store, process, and display Your Content solely to operate and provide the Service to you. You are responsible for ensuring you have the rights to any content you submit.

5. Generated Code

The Service generates Arduino/ESP32 source code based on your diagrams. Generated code is provided "as is". You are solely responsible for reviewing, testing, and validating any generated code before deploying it to hardware or production environments. We make no warranty that generated code is correct, complete, secure, or fit for any particular purpose.

License to generated code. Unless you hold a Commercial-Use License (Section 8), code generated for you is licensed to you for personal, non-commercial use only. Within that scope the license is perpetual, worldwide, and royalty-free: you may use, modify, and keep the code, including after your account or any paid plan ends. It does not permit you to sell the generated code, incorporate it into a product or service you sell or otherwise commercialize, or distribute it as part of a commercial offering. Each generated file states the license it was produced under in a comment at the top of the file.

6. Plans, Billing, and Renewal

The Service offers a Free plan and a paid Pro subscription. Current prices and the limits of each plan are shown on the pricing section of our site and in the application, and are stated and charged in U.S. dollars.

  • Automatic renewal. Pro is a recurring subscription. It renews automatically at the end of each billing period — monthly or annual, whichever you selected — and your payment method is charged the then-current price for that period, until you cancel.
  • Payment processing. Payments are processed by Stripe. We do not receive or store your full card details. You authorize us, through Stripe, to charge your payment method for each renewal.
  • Cancelling. You may cancel at any time from Account & Plan in the application, which opens Stripe's billing portal. Cancellation takes effect at the end of the period you have already paid for: you keep Pro access until then, and the account reverts to the Free plan afterwards. Cancelling does not retroactively refund the current period.
  • Failed payments. If a renewal payment fails, Stripe may retry it. Your access may continue briefly during retries, but ends when the period you last paid for expires.
  • Price changes. We may change prices. A change applies only to billing periods beginning after we notify you, and never to a period you have already paid for. If you do not accept a new price, cancel before the next renewal.
  • Free plan. The Free plan is supported by advertising and is subject to the daily limits shown in the application.

7. Credits

Server-side actions — code generation, compiling, and AI diagram generation — are metered in credits, each with its own pool. Every plan includes a daily allowance of each, which resets at midnight UTC and does not carry over. You may also purchase credit packs.

  • Purchased credits do not expire and are used only after that day's included allowance is exhausted.
  • Credits are tied to your account. They are not transferable, cannot be exchanged or redeemed for cash, and have no cash value.
  • A credit is spent when the action is performed. Re-running a code generation with no changes, and a compile that fails, are not charged. If an AI generation fails, that credit is returned.
  • Purchased credits remain available if your Pro subscription ends; they are not tied to a plan.

8. Commercial-Use License

The Commercial-Use License is a separate, one-time purchase that removes the non-commercial restriction in Section 5. It is not a subscription and is not included with Pro; the two are bought independently and neither grants the other.

  • What it grants. A perpetual, worldwide, royalty-free, non-exclusive license to use, modify, and distribute code generated by your account in commercial products, with no per-unit or per-device royalty.
  • Perpetual and per-account. It is purchased once per account and does not expire or renew. Because it is not tied to a subscription, it survives cancelling Pro, and it continues to cover code you generated while you held it.
  • What it does not grant. Any right in the Service itself, the code generator, or our branding (see Section 10), or permission to resell or redistribute the Service or its generator.
  • License identifier. Files generated under the license carry a License ID identifying the license they were issued under. It is derived from your account identifier and cannot be reversed into your account details by a third party. You may leave it in code you distribute, and you agree not to remove or alter it in order to misrepresent the license under which code was generated.
  • The license is non-transferable and may not be shared across accounts, organizations, or resold.

9. Refunds

Except where a refund is required by applicable law:

  • Subscriptions. Payments are non-refundable, including for partial periods. Cancelling stops future charges and leaves your access in place for the remainder of the period you have paid for.
  • Credit packs. Non-refundable once purchased, since credits are available for use immediately.
  • Commercial-Use License. Non-refundable once purchased, since it grants perpetual rights immediately and cannot be recalled.

If you believe you were charged in error — a duplicate charge, or a charge after a cancellation took effect — contact us at admin@g9six.com and we will review it.

10. Intellectual Property

The Service, including its software, code generator, design, and branding, is owned by G9Six, LLC and is protected by intellectual property laws. Except for Your Content, and the code generated for you under the license described in Sections 5 and 8, no rights are granted to you other than the limited right to use the Service under these Terms.

11. ESP-GenUI Mobile App

We publish a companion mobile app ("the App") that connects over Bluetooth Low Energy to ESP32 devices running firmware generated by the Service. These Terms apply to the App as well as the website; this section adds terms specific to it, and governs where the two differ.

11.1 Licence to use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for the purpose of operating ESP32 devices running firmware you generated with the Service or are otherwise authorised to control. You may not redistribute the App, sell it, rent it, or offer it as a service to others. Your use of the App is also subject to the terms of the app store you obtained it from.

The App requires no account and is provided free of charge. Nothing in Sections 6 through 9 (plans, credits, the commercial-use licence, and refunds) applies to it. The commercial-use licence described in Section 8 concerns code generated by the Service; it neither restricts nor extends your use of the App.

11.2 Your devices and your responsibility

The App is a control surface for hardware you build and program. You are solely responsible for what your devices do, for the firmware you put on them, for the wiring and equipment they drive, and for the consequences of any command you send through the App.

Do not use the App, or the devices it controls, for any purpose where a failure could result in death, personal injury, or serious property or environmental damage. This includes life-support, medical, aviation, automotive, weapons, nuclear, and industrial safety-critical applications, and any unattended control of heating, electrical, water, or other hazardous equipment. The App gives no guarantee that a command will be delivered, that it will be delivered on time, or that a displayed value reflects the current state of the device.

11.3 Connectivity

The App communicates only over Bluetooth Low Energy, directly with your devices. Whether it can find and hold a connection depends on your phone, its operating system and permissions, Bluetooth conditions around you, and the firmware on the device — much of which is outside our control. A Bluetooth connection can drop at any time, including in the middle of an operation.

11.4 Fleet codes

The App lists only devices matching a fleet code you have added. A fleet code determines what your App displays. It is not a password and not a security control. It is broadcast in the clear by every device built with it and can be read by anyone nearby with a standard Bluetooth scanner. What a device permits a phone to do is governed by Bluetooth pairing and, where the device's designer enabled one, a passkey — configured in the diagram, not in the App. You are responsible for securing your devices appropriately for what they control, and for not relying on a fleet code to do it.

11.5 Wi-Fi setup

Where a device supports it, the App can pass Wi-Fi credentials to that device over an encrypted, paired Bluetooth link. You are responsible for the credentials you enter and for having the right to connect that device to that network. We never receive those credentials; see our Privacy Policy.

11.6 Availability

We may update, change, or withdraw the App at any time, and app store availability, supported operating-system versions, and device compatibility may change. The App is provided "as is", on the same terms as the rest of the Service — see Sections 14 and 15.

12. Third-Party Services

The Service relies on third-party providers, including Google Firebase and OAuth login providers such as Google. Your use of those providers is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.

13. Service Availability and Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. If we discontinue the Service or a paid feature you have prepaid for, Section 16 governs what happens to that payment.

We may also update these Terms from time to time; continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Where a change materially affects a paid plan you are subscribed to, it applies from your next renewal rather than the period you have already paid for.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, G9SIX, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

16. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason at our discretion. You may stop using the Service at any time, and may cancel a subscription as described in Section 6.

If we terminate your account for a breach of these Terms, unused credits and any remaining paid subscription period are forfeited without refund. If we discontinue the Service or terminate your account for any other reason, we will refund the unused portion of a prepaid subscription period. In either case, the license to code already generated for you — including a Commercial-Use License you have purchased — survives, because it applies to files already in your possession and does not depend on continued access to the Service.

17. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the courts located in Florida.
